fileink.com respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This Copyright Policy explains how we handle copyright infringement claims and takedown notices.

 

Notification of Claimed Infringement

If you believe that content on our website infringes your copyright, you can submit a notification of claimed infringement to our Designated Copyright Agent. Your notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) that you claim has been infringed.
  3. Identification of the material that you claim is infringing and the location of that material on our website (e.g., a URL).

Our Response to Notifications

Upon receipt of a valid notification of claimed infringement, we will:

  1. Promptly remove or disable access to the material that is claimed to be infringing.
  2. Forward the notification to the user who provided the material.
  3. Take reasonable steps to promptly notify the user that we have removed or disabled access to the material.

 

Counter-Notifications

If a user believes that the material they provided was removed or disabled by mistake or misidentification, they can submit a counter-notification to our Designated Copyright Agent. The counter-notification must include the following information:

  1. A physical or electronic signature of the user.
  2. Identification of the material that has been removed or to which access has been disabled and the location of the material before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. The user's full legal name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user's address is outside of the United States, for any judicial district in which the service provider may be found, and that the user will accept service of process from the person who provided the original notification or an agent of that person.

Upon receipt of a valid counter-notification, we will:

  1. Provide the copyright owner with a copy of the counter-notification.
  2. Inform the copyright owner that we will replace the removed material or cease disabling access to it in 10 to 14 business days.
  3. Replace the removed material or cease disabling access to it in 10 to 14 business days, unless the copyright owner notifies us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our website.

 

Repeat Infringers

We have a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances. Repeat infringers are users who have been the subject of multiple valid DMCA takedown notices.

 

Limitations of Liability

We are not liable for any claims related to our removal or disabling of access to material pursuant to this policy, provided that we have acted in good faith.
